community, judges and other attorneys in your area play a large role in potential trial results. Most cases
settle, only because trial is possible. If you retain an unknown attorney who is not capable of trying cases
well, because of this perceived weakness, opposing attorneys frequently demand trial to exploit the advantage.
State bar associations provide a wealth of information online. Once you select an attorney to interview, call
the state bar and ask for all public information. Disciplinary records are available, but only for inquiries
that resulted in a positive finding of attorney misconduct. Frequently, for minor first violations, state bar
associations issue "private reprimands" that are not divulged. If you encounter an attorney with a public record
of misconduct, proceed cautiously. |
