Divorce Law Questions
Over the last few years (since 2001) the trend for state
legislatures has been to repeal existing divorce laws. The common law developed by each state from the inception
of statehood is now being systematically repealed, and replaced by uniform codes. This globalization of U.S. law
remains highly controversial due to partisan concerns. Proponents argue consistency creates family stability
through stringent government regulation. Opponents argue the prohibition against legislation of morals has been
violated causing infringement upon personal freedoms, and further claim the lack of separation between church
and state violates individual rights guaranteed each citizen by the U.S. Constitution. Family law lawyers and
their clients remain in a state of flux.
