Divorce Lawyer Duties
In the simplest uncontested case involving nominal assets and no children, divorce lawyers may not be
required. In all other cases, attorney fees are minor compared to potential liability, loss of children,
loss of assets, and adverse court decisions caused by poor skills interrupting laws. Family laws are complex and
a lawyer's arguments
slanted. Each element of right, title and
duty must be technically plead, in writing, and proved in court according to rules of evidence. If you miss one
step (an element of law supporting a cause of action), the entire issue is lost. Divorce cases potentially involve hundreds
of issues.
Divorce Lawyer Services
The duties and services divorce lawyers provide family law clients include:
- Advising clients of legal and private options, including costs, benefits, burdens, and potential liability
- Estimating probabilities of possible outcomes
- Negotiating on clients' behalf and eliminating further contact with adverse parties
- Recommending contacts and resources related to divorce issues
- Preparing and filing all documents
- Attending all hearings on behalf of clients
- Assist in answering interrogatories, requests for production, and requests for admissions
- Providing all documentation to opposing counsel
- Assisting clients during depositions
- Obtaining favorable expert opinions, when required
- Guaranteeing compliance with all laws and rules of court
- Representing clients in mediation
- Settling upon agreeable terms or arguing cases at trial(s) and appeal(s)
Divorce Lawyer Responsibilities
All divorce lawyers must be licensed by the state bar. By accepting licensure, divorce lawyers take a sworn
oath to abide by the rules of professional responsibility and cannons of ethics. At a minimum, lawyers must
fully disclose all fees, fully explain client rights, duties and obligations, timely respond to all discovery
requests and court hearings, return phone client phone calls within a reasonable time, and zealously represent
their client's best interest at all times. A violation of these duties may be grounds for discipline if filed as
a grievance.
