Prosecutors in Los Angeles acknowledged they prosecute the wrong man for paternity and collection of
child support, on average, 350 times each month. Each man wrongly accused must pay for his own legal defense and
DNA testing. Other common child support and divorce questions arise from:
- Paternity fraud
- False allegations of abuse
- Falsification of payments received
States are slowly addressing abuse in the child support system, largely as the result of the much publicized
Bradley Amendment. (The day he returned home to a hero's welcome, Bradley was arrested for non-payment of child
support due while he was an Iraqi hostage).

- Divorce questions relating to legal requirement are ultimately resolved by a judge. Lawyers should advise
clients on the likelihood of success when pleading a more favorable outcome.
- Divorce questions which involve the best interest of children are determined by the court, ordinarily
based upon expert depositions, testimony and reports.
- Other divorce questions and factual disputes are resolved by juries, unless by agreement a jury is
waived,. In bench trials, judge perform the roles of both judge and jury.
- Ordinary divorce questions and disputes over small legal issues are commonly decided by the agreement of lawyers or
spouses without involving the court.
