Following a divorce, kids react differently. The sky may be falling, or mom and dad may need to chill in a
child's mind. The support and divorce questions discussed with a lawyer may instill fear in parents, while these
issues are lost on kids. Most kids while know parents are arguing, experience loss, and know when times are
hard. They need reassurance and may hope in vain for reconciliation.
Professional counselors deal with kids' divorce questions more effectively than most parents. Objective
professionals listen to a child's questions, and provide responsive answers in terms that can be understood. Too
often, parents respond to children with parental issues, and tend to be overly critical of a soon to be ex.
How Divorce Questions are resolved:
- Legal divorce questions pertaining to rules and cases must be rendered by a judge. Attorneys advise
clients of probabilities of various outcomes along a sliding scale of least to more favorable
- Academic divorce questions relating to the children are resolved by the court
based upon the opinion of qualified experts, through deposition, narrative reports and testimony.
- Factual divorce questions relating to marriage are determined by a jury empanelled by the court, unless a
jury is waived. In non-jury trials (bench trials) the court assumes the responsibilities of both judge and
jury.
- Minor divorce questions of convenience are ordinarily determined by agreement of attorneys for legal
issues, and parents for custody issues.
